Madisen Brooke Comstock, 21, and David Alvarez, 38, have both been indicted on the charge of abandoning or endangering a child, a State Jail Felony, after meth was found in a child’s system.
Comstock is the mother of the male infant and Alvarez is her boyfriend.
The indictment states that the defendants on June 29, 2022, “did then and there intentionally, knowingly, recklessly or with criminal negligence, engage in conduct, by act or omission, that placed a child younger than 15 years of age, in imminent danger of death, bodily injury, of physical or mental impairment, by engaging in conduct that was related to the proximity or accessibility of the controlled substance methamphetamine to the child.”
The indictment also states an analysis of the child’s blood, urine or other bodily substance indicated the presence of meth in the child’s body and the defendants did not voluntarily deliver the child to a designated emergency infant care facility provider under Section 262.302 Family Code.
Other indictments returned July 6 included: Carlos Alberto Benites, 23, manufacturing or delivery of a substance in penalty group 1, four grams or more but less than 200 grams (First Degree felony); Danny Duarte, 37, driving while intoxicated third or more (Third Degree felony); Hayes Loyd Fuller, 28, possession of a substance in penalty group 1, less than one gram, enhanced (State Jail felony) and theft, less than $2,500 with two previous convictions (State Jail felony).
